Maintenance, Repair, Support Policies
1.0 Overview
The two most important goals of C-Map Systems are to provide our clients with
the highest possible quality products and to insure our customers' satisfaction
with those products. Toward these goals we offer several areas of product
support to keep our systems operating as designed.
2.0 User Training
C-Map includes with our more complex system packages (i.e. Mission Manager -
PIS) several days of on-site training. This gives client operators a chance to
discuss in-depth, software design, function, and operation as it pertains to
their specific application, and to receive hands on training from a C-Map
technician. It also allows our technicians a chance to trouble shoot the new
software installation and hardware configuration.
3.0 Technical Support
C-Map Systems provides unlimited free technical support via telephone, fax, or
E-mail for all products for a period of one year from date of delivery. After
that time C-Map Systems will continue to provide a "reasonable"
amount of free technical support. It is the sole decision of
C-Map Systems as to what is considered to be
"reasonable".
If any defects in C-Map software are
discovered and repaired by C-Map, we will provide the maintenance upgrade
software to all users of that particular product free of charge. In addition
any hardware recalls for repair or free upgrades issued from a specific
manufacturer will be passed along to our clients. This service will continue
for as long as the client owns and operates the system.
C-Map Systems will continue to support any
version of a product for a full three years after the date of release of a new
version or the date of discontinuance of that product.
4.0 One Year Limited Warranty
A one year limited warranty on software and hardware is in effect from the date
of acceptance of a system by the client.
4.1 Software Warranty
If there are any physical defects in the medium on which the software or documentation is distributed, C-Map Systems will exchange the materials at no charge. To qualify for this warranty return the defective medium during the 365 day warranty period.Except as set forth in the immediately preceding paragraph, C-Map Systems, inc. provides the software and documentation "as is" and without warranty of any kind either expressed or implied, including but not limited to, any implied warranties of merchantability or fitness for a particular purpose or warranties of quality of performance. You, the licensee are assuming the entire risk as to the quality of the software and the documentation and the results of its use.
Your exclusive remedy with respect to the software, the documentation, and the license agreement shall be limited to the replacement of any defective medium, or refund of the purchase price of the software as set forth above.
IN NO EVENT WILL C-MAP SYSTEMS INC. BE LIABLE FOR DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE OR DOCUMENTATION, even if advised of the possibility of such damages. In no event shall C-Map Systems Inc.'s liability with respect to the software, the documentation and this license agreement, in contract, tort(including negligence) or otherwise, exceed the original price paid by you for your product.
THE WARRANTY AN REMEDIES SET FORTH ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHERS, ORAL OR WRITTEN, EXPRESSED OR IMPLIED. SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIABILITY OR DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.
This license and warranty are governed by the laws of the State of Texas, USA.
4.2 Hardware Warranty
C-Map systems warrants all hardware to be free from manufacturing defects for a period of 12 months from date of delivery. Hardware must be returned to C-Map Systems at the buyers expense for repair. Damage due, in the sole discretionary opinion of C-Map Systems, to abusive use of the equipment, or use of the equipment in an environment or manner for which it is not designed, is not covered under the terms of this warranty. Any hardware supplied by C-Map Systems Inc. is supplied under the warranty of the original manufacturer. This coverage may exceed that offered by C-Map Systems in scope and/or time period. C-Map Systems Inc., at its sole discretion and on a voluntary basis, and under no obligation to the buyer, may choose to assist the buyer in obtaining warranty service from the manufacturer.
5.0 Optional Maintenance Contracts
As an added cost option, C-Map Systems offers maintenance contracts to cover
all necessary support services for hardware and software over a period of time
defined by the contract. (Generally one year.) Maintenance contract services
include:
5.1 Technical Support
Under the terms of a maintenance contract, C-Map Systems will provide unlimited technical support via telephone, fax, and E-mail for the duration of the contract. In addition C-Map will provide a technician on-site at the client's location for a period of days (specified in the contract), as required to support the installation of upgrades, and testing and integration of systems with other client systems. Travel and subsistence costs for technician are not covered by the contract and shall be billed to the client.
5.2 Software Version Upgrades
Any software version upgrades or improvements to the product which the client owns, that are released during the effective period of a maintenance contract shall be supplied to the client at no charge. Installation and testing of the upgrade software is included.
5.3 Hardware Repair
Hardware for client's systems covered by the contract will be repaired or replaced as required when a failure occurs in normal usage. C-Map Systems will make the final decision whether to replace or repair an item. Equipment will be shipped (both directions) at the client's cost to the repair site designated by C-Map Systems.
